Working on my own idea.....

When I was making the Loop-di-Loop Doily I noticed that a section reminded me of a Christmas tree. So I decided to make that section and see if it would look like a Christmas tree when not part of the doily. Here is the result-yes, it looks like a Christmas tree to me. Question.....would it be in violation of a copyright to use this section? Wanting to make my own Christmas tree ornament pattern.

IMHO......Because it is a part of someone else's pattern does not change the fact the copywrite still belongs to them, for the pattern in part or in whole is still theirs.
You might like to take the same shape, and create a design of your own inspired by the original, but I think you would still need to credit them for the inspiration.
I have no expertise in this area. This is just my opinion.

If you are making it for your own personal use, and the pattern was given or purchased, I think it's okay to make. The problem would be if you posted it as your own design, or tried to sell the item.
